What is an affidavit?

An affidavit is a written statement of facts that you swear is true, by oath or affirmation, in front of someone authorised to administer oaths, such as a notary public. It’s used as evidence, most often in court proceedings, and lying in an affidavit can be prosecuted as perjury.

Frequently asked questions

How much does it cost to have an affidavit notarised?
From £120 per affidavit for the notary. If it’s going abroad, the FCDO apostille is £59 (standard) or £79 (next day). Embassy legalisation is quoted separately where needed.
Can an affidavit be sworn by video call?
Yes, our notary can administer the oath or affirmation by video call. Some courts and authorities only accept affidavits sworn in person, so we check before you book.
Do I have to swear on a religious text?
No. You can swear an oath on the religious text of your choice, or make a non-religious affirmation. Both are equally valid.
What is the difference between an affidavit and a statutory declaration?
An affidavit is sworn on oath or affirmed and is mainly used as evidence in court proceedings. A statutory declaration is formally declared without an oath and is used for non-court matters. Check which one the receiving authority has asked for.
Can you draft my affidavit?
Send us what the court or authority has asked for and we’ll advise on the format before your appointment. For legal advice on the content of court evidence, speak to your lawyer.
What are exhibits?
Documents your affidavit refers to, such as certificates or letters. The notary marks each one so it’s formally attached to your affidavit.
Does an affidavit need an apostille?
For use abroad, usually yes. The UAE, Qatar, Kuwait, Egypt and Thailand also need embassy legalisation after the apostille, which we arrange.
What should I bring to the appointment?
Your valid passport, the unsigned affidavit and any exhibits.
